I received my first ever yellow DHL shipped envelope straight from Geneva, Switzerland the other day. Yep a UDRP.

I had already received the emails with the 200+ exhibits and got about 10 emails from Attorney’s offering their services to help me fight and win this epic battle against corporate domain hijacking. I declined their offers.

I’ve had a change of heart about my assumption that this was a case of a corporate power and greed. I now think it’s a case of legal service extortion with the corporation being the victim and with that said, still reverse domain name hijacking.

The domain in question is StayFree.xyz, apparently Stay Free is a brand for feminine hygiene products. When I registered these generic words for 50 cents, I was thinking about things like hotel accommodations or maybe “don’t go to jail”,  I wasn’t in any way thinking about small menstruation diapers or whatever the hell they sell.

I mean seriously they did a shitty job of branding that product. “Here’s our maxi pad so you can stay free”. Stay free of what? Menstrual fluid running down your leg? It doesn’t even make sense. In any case I know that I didn’t register the name in bad faith, because I didn’t associate this generic two word name with this or any trademarked product.

The legal firm contacted me about another name prior to the stayfree discussion. That name was binky.us. They showed me the trademark and I said, “hmmm I didn’t know that was a trademark, I thought the term was generic and I also mass registered those .us names, so here you go” I transferred the domain to them without any issue. I did this not because I had registered the name in bad faith, but because I wasn’t aware that it was a specific one word brandable that has no other use.

They then contacted me about stayfree.xyz. I said I agree with the other name, but this one is totally generic. There were no ads showing on the domain as there were with binky, even if there had been, no one would have seen them. The only traffic if any, a newly registered .xyz is getting is bot traffic, no one is directly navigating there.

The name was and still is listed on uniregistry market with a BIN price of $199 USD. So the corporation is willing to spend $10K+ for this law firm to file a UDRP, put the case together and take away my 50 cent .xyz, that is made up of generic words?  That seems like really bad business.

Why haven’t they filed UDRP’s on StayFree.net or StayFree.org? Both of those names are currently listed for sale and show ads for feminine hygiene products. Both of those names have been registered for over 10 years and have the whois set to private.

So was I an easier target for this lawfirm to generate work and billable hours? Are they out there trolling for domains that don’t have whois privacy?

The law firm owns their name in four legacy extensions. I just registered their name in 5 CCtld’s .lawyer and .attorney, so they can now practice filing real UDRP cases. In the meantime, I’ve built the names out into really nice Donkey Porn sites.

  2. My wife always asks me, “do you want to be right or do you want to be effective?”

    I’d question whether the legal firm representing “Stay Free” is doing what is in the best interest of their client and is being effective on their behalf.

    The end result should be to secure their intellectual property with the least expense as I’m sure “Stay Free” is a company with shareholders. Nobody appreciates wasted expenses.
