Under ICM’s Content Requirements You Will Not Be Able to Park Your .XXX Domains?

I put an email in to Daniel Le Ray regarding sales and parking of .XXX domains.  His summarized response was this.  Any Sedo customer can now park and sell their new .xxx domain at Sedo.  The standard minimum fee applies ($50 EUR/USD) BUT and a big but… before parking a domain they may want to review the ICM Registry content requirements. I typed them out below for all to see.  (No cut and paste from ICM’s site, all pics no text for Google to pick up on)

To have your domain become a live website, you must Self-Attest to being a member of the Sponsored Community and complete the membership application. Below is a definition of the Sponsored Community, with example, as well as the Membership process all member will have to complete.

Our Sponsored Community consists of individuals, business, entities, and organizations that fit any one of the following descriptions

  • Provide online adult entertainment intended for consulted adults. (Providers) (eg. adult webmasters, performers, studios, store owners, club operators)
  • Represent Providers (“Representatives:) (eg. lawyers, agents, advisors, accountants, affiliates)
  • Provide products or services to providers or representatives (“Service Providers”) (eg. adult domainers, manufacturers, deliver companies, caterers, distrobution companies, merchant account services, makeup artists, stylists, hosting services)

To me it’s pretty straight forward. Parking would certainly be against the rules to this agreement and therefore would prevent the owner from having a live site.  ie no income.  If parking is not allowed this would seriously reduce future registrations. I’d love to hear if anyone has looked into this or has is reading the agreement differently.

Edit:  .xxx representatives said you can park but at this point have given no further details.  Park away

  1. I looked into it also Shane and it is pretty vague…
The IFFOR policies are more clear.
Content has to be adult and that violations lead to actions.

    Actions:
Registrants determined to be in violation of any other IFFOR Baseline Policies shall be notified via email and given a reasonable period of time to come into compliance. The registration of any registrant failing to cure the identified violation in the specified time frame may be terminated. Registrants determined by ICM to have repeatedly violated the IFFOR Baseline Policies, any IFFOR Best Practices Guidelines, and/or ICM Registry Policies, may be disqualified from maintaining existing registrations in the sTLD or making future registrations in the sTLD.

Still i am not sure if the adult parking themes from several parking solutions are in violation or not. Some are rather errr well you know…

  2. I’m not sure I follow your logic …? I don’t see/read any specific “non-parking” clause in what you highlighted??

Alternately, I assume most ‘parkers’, including myself, would classify themselves as a “Domainer”. And, assuming you have at least a few domains (IN ANY EXTENSION) that are somewhat related to the porn/xxx industry, I believe the title of “Adult Domainer” could be claimed.

So, quoting from above (capitalization emphasis added):

“…Provide products or services to providers or representatives (“Service Providers”) (eg. ADULT DOMAINERS)…”

Therein, so long as you are an “Adult Domainer”, I don’t see why one could not park and/or try to sell via the domain aftermarkets your .xxx domains.?

Or, am I totally missing something??

    Cheers
    Steve

    1. Steve,
The selling part is clearly covered in the Adult Domainer section. You could be right about the parking but there is a reason why a Sedo Representative says you should look into that clause. Have you heard of anyone parking the domains yet? Show me one parked name and then we can end the discussion.

    2. Steve,

I talked to Frank Schilling and he and I are in agreement. It is his understanding that you have to wait at least one year before parking. It’s not to say you can never park but not at this moment. I’m looking for a definitive answer but a major .xxx owner with one of the largest parking platforms agrees here. Again though, neither one of us knows 100% the answer

  3. in GoDaddy accounts that have obtained .XXX domains there is a message that states ‘In order for your .XXX domain to resolve, you must enter your ICM membership number’ or something along those lines. I didn’t even think about it before, but without the membership number that you must obtain from ICM, I guess this means the domains wouldn’t even resolve to parked pages?

  4. Shane how did you and Frank come up with the 1 year thing ? That’s pretty odd.
I see no mention anywhere of that.

    1. Theo,

His words not mine. Go to domainnamesales.com for his exact words. I’m not arguing anything just stating it as I see it combined with the fact I have yet to hear or see a parked domain

Karl, thank you. We’ll see if that stays up. Happy to see the warning.

  5. @Shane:

My first reaction to your last comment (re: discussion with Frank Schilling) was that if anyone would know the rules, Mr. Shilling would!

… But, the “1-year” proviso again makes me question it all again. I do not recall any “1-year only” clauses pertaining to any of the stipulations I read in either the IFFOR or ICM requirements.**

[**I am going off of memory from several weeks ago .. so there may indeed be something there]

FYI – Despite using Snapnames & Pool to try to grab a select few 1-word .xxx domains; I nonetheless was unsuccessful (…so I have no ‘skin in the .xxx game’).

    Steve

    1. Thank Kevin,
I understand now that the names can be park. I only questioned it because Sedo did and when I asked Frank Schilling, even he wasn’t sure. .xxx gave a fantastic, thorough explanation with “yes you can park” so all is settled :).

  6. The best thing would be to avoid parking for .com domains. I am website developer and not domain investor and if I am looking for domain names all .com’s are registered and parked but almost non of the sites are developed.
Even exact match keywords with few hundred searches are taken and that’s ridiculous as no one will ever buy those domains for premium price.

If someone has solid domain portfolio with exact match domain names and are tired of paying for renewals can hit me up for better solution.

  7. It would be a shame to park a domain name I just paid $100 to hand registered. I think I made a misstake. I should have registered RichUncle.xxx. But now I am broke. So it served me right not having the name.

  8. I asked this very question from the Registrar Liaison in June as we were preparing for offering .XXX domains, and I was assured that as long as the parked content related to the adult industry (i.e. ads for escorts, adult services or products, etc.) it was fine.
